NOTE: All Participants, upon admission to Reggies' Sleepout, will be required to sign a waiver and release of liability, a consent to Reggies' Sleepout "Rules and Regulations" and "Code of Conduct" and a consent to use a Participant's image in photographs and video for promotion of future sleepout events. If a Participant is a minor under the age of 18 years, the Participant must have a parent or guardian sign the minor consent form on the minor's behalf and bring it to the event at the registration table. The minor consent form can be downloaded at Minor Consent Form BY clicking on "I AGREE BELOW", you, as the Participant, are consenting to the following: 1. THE PARTICIPANT will immediately inspect the Drake Stadium (the location of Reggies' Sleepout) upon entering it and warrants that their entry therein constitutes an acknowledgment that he/she has inspected the Drake Stadium and finds it safe and reasonably suited for the purpose of its use. The Participant agrees that if at any time in the Drake Stadium he/she believes something is unsafe, it will be brought to the attention of an official, and he/she will remove himself/herself from the Drake Stadium and will withdraw from participation in the Event. 2. THE PARTICIPANT HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to negligence of Releasees (as identified below) or otherwise, while in or upon the Drake Stadium for any purpose including competing, officiating, observing, working or participating in the Event. The Participant recognizes and understands that there are risks and dangers associated with participation in the Event and admission within the Drake Stadium that could cause severe bodily injury, disability and death. Further, the risks and dangers may be caused by the negligent failure to act of the Releasees and others. All of the risks and dangers associated with participating in the Event and entry into the Drake Stadium are assumed notwithstanding. 3. THE PARTICIPANT releases, waives, discharges and covenants not to sue the promoters, participants, associations, sanctioning organizations, (or any affiliates thereof), stadium operators, stadium owner, officials, sponsors and advertisers used to conduct the Event and their officers, agents, and employees (all for the purpose herein referred to as ("Releasees"), from all liability to him/her, his/her personal representatives, assigns, executors, heirs, and next of kin for any and all claims, demands, losses or damages of the Participant on account of any injury, including, but not limited to the death or injury of the participant or damage to property, all of which is caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise. 4. THE PARTICIPANT hereby agrees to indemnify and save and hold harmless, the Releasees and each of them from any loss, liability, damage or cost that may occur due in any manner or degree to the presence of the Participant in the Drake Stadium, or in any way while participating in the Event and whether caused by negligence of the Releasees or otherwise. 5. THE PARTICIPANT hereby agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasees, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 6. THE PARTICIPANT hereby agrees to abide by the following RULES AND REGULATIONS and CODE OF CONDUCT: - After 12 a.m. on the evening of the Event, Participants who have left the Event premises will not be readmitted to the Event. - All bags, backpacks, boxes, shelters and other containers are subject to inspection at any time. - If a Participant is under the age of 16 years, the Participant shall be accompanied by an adult who shall be present at the Event. - General safety and respect for other participants will be expected at all times. The following behaviors shall be considered detrimental and may result in expulsion from the Event: - Willful damage or vandalism to Drake Stadium or individual personal property. - Possession of fireworks or weapons of any kind. - Possession or use of alcohol, tobacco, or any controlled substances. - Willful or consistent misbehavior considered to be disruptive to the Event or to other Participants. - Failure to comply with Event rules or with requests made by Event administrators. 7. Any photographs, videotaping or other records of the Participant at the Event may be used to promote future Sleepout Events. This includes, but is not limited to, use of a Participant's photograph and video on Reggies' Sleepout web site, television, printed billboards, brochures or other promotional materials. THE PARTICIPANT HAS READ AND VOLUNTARILY SIGNS THE WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT AND DOES SO VOLUNTARILY AND WITH THE UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP.
